Advice and warning
Council education and advice are given on an individual and group basis depending on the issue and circumstances. As and when required regional councils also use enforcement on a case by case basis. Very minor offences may receive a warning from the regional council enforcement officers. Minor offences may result in infringement notices and recidivist minor offences or major offences may result in prosecution.
Warning
There is no formal RMA process for issuing warning. Depending on the council enforcement policy, environmental thresholds, and circumstances a warning (either written or verbal) may be issued by the enforcement officer. Council or enforcement officers of the council are not obliged to issue warning. Depending on the council cost recovery policy there may be a charge incurred in accordance with the council’s Annual Plan under the Local Government Act for officer’s inspection and related costs.
