By nature of the activities utility operators are accorded exemptions under the Act when works are carried out under emergency.

However, correct RMA processes have to be followed under s330 of the Act.

Utility and network operators or requiring authorities  (e.g. power and line companies, large irrigation networks etc) are considered here to highlight matters related to work performed under the emergency provisions of the RMA.

Requiring authorities are designated under the Act and are generally utility or network operators or irrigation schemes or local authorities. Under an emergency situation (e.g. natural hazard) there are exemptions under s330 of the Act to undertake certain activities without consents or not complying with the permitted activity rules.

Consequences of not complying
