Consequences of not complying

Any smoke, particulate, gaseous or odour emission not complying with the permitted activity or consent conditions may result in an infringement fine of $1000 or prosecution.

Any discharge to water not complying with the permitted activity or consent conditions may result in an infringement fine of $1000 or prosecution.

Non-compliance with the water measuring device regulation (e.g. not installing or recording as per the regulation) may result in an abatement notice to comply. If not complied with the abatement notice a fine of $750 or prosecution may be likely.

Failure to comply with a resource consent or permitted activity rules or undertaking an activity without a resource consent (this situation also applies to operating once a resource consent has expired) may result in an infringement fine of up to $1000 (depending on the activity) or prosecution.
Note: Some discharge related infringement fines and all prosecution fines are greater for industrial and trade premises. For example a smoke emission related infringement fine for a farm or household will be $300 and for an industrial or trade premise it would be $1000. Prosecution fine could be up to $600,000 for a trading company as against up to $300,000 for an individual.
